You're right. I've seen Tim do it both ways. I've also seen the 12th fret on the D substituted for the 7th on the G.

All those 10's on the e string that you have on the second to last bar are actually played on the 15th fret of the b string I think. At least from the sound of it.

I like dominant #9 chords. It's funny how funk relies on it so much and yet it doesn't really seem to get that old. However play a b9 b13 and people think it sounds funny.
